@hikari At least, the US Constitution prohibits passing laws which apply retroactively (en.wikipedia.org/wiki/Article_), but obviously yes surveillance would be used on any new instances of such "criminal acts"

@aismallard the problem is that this doesn't prevent court decisions from having retroactive effect, and various southern US states still have anti-sodomy laws on the books
